GENERAL INFORMATIONS
These General Conditions of Sale have as their object the purchase of products made remotely via the Internet on the site www.marricreo.com, belonging to MARRICREO di Simona Novi. Each purchase transaction will be regulated by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information aimed at the conclusion of the contract will be subject to art. 12 of Legislative Decree 70/03 and, as regards the protection of confidentiality, will be subject to the regulations of Legislative Decree 196/03.
PERSONAL DATA PROCESSING
MARRICREO di Simona Novi, pursuant to art. 13 of Legislative Decree 196/2003, informs that the personal data, including personal and fiscal data, acquired verbally in reference to the established commercial relationships, provided directly by the interested parties, or otherwise acquired in the context of the company's activity, will be processed in compliance with the aforementioned legislation, including the confidentiality obligations provided for therein.
In relation to the aforementioned, the rights referred to in Article 7 of Legislative Decree 196/2003 may be exercised.
OBLIGATIONS OF THE CUSTOMER
The Customer is required, before forwarding his purchase order, to carefully read these general conditions of sale. Forwarding the purchase order implies their full knowledge and acceptance.
Finally, once the online purchase procedure has been completed, the Customer is required to print and keep these general conditions of sale, already viewed and accepted during the contract conclusion phase.
ORDER DEFINITION
By sending the order online, the Customer sends MARRICREO di Simona Novi a proposal to purchase the product and/or products placed in the cart. When the Customer places an online order for the products placed in the cart, he/she agrees to purchase them at the price and terms indicated in these General Conditions of Sale.
MARRICREO by Simona Novi will communicate to the Customer the acceptance and confirmation of the order.
In particular MARRICREO by Simona Novi will not accept orders:
if the material is not available in stock at the time of the order and/or
if the Customer cannot or does not want to pay using credit cards (Paypal), bank transfer or cash on delivery.
It is possible to place an order both through the website www.marricreo.com at the prices and conditions indicated therein and through authorized retailers.
PURCHASE METHODS
The customer purchases the product, the characteristics of which are illustrated online in the relevant descriptive and technical sheets, at the price indicated therein to which are added the delivery costs as specified on the site.
Before sending the purchase order, the unit cost of each selected product is summarized, the total cost in the case of purchasing multiple products and the related delivery costs.
Once the purchase order has been sent, the customer will receive an email from MARRICREO di Simona Novi confirming receipt of the purchase order and containing information on the main characteristics of the purchased item, detailed information on the price, delivery costs, applicable taxes and payment methods and containing a reference to the general contract conditions and information on the existence of the right of withdrawal, the conditions and methods of exercising it displayed on the site. Following the approval of Legislative Decree 4 July 2006 n. 223 “manoeuvre bis” Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which came into force on 12 August 2006, which reinstates the obligation to communicate the list of customers and suppliers in the event of issuing an invoice, and of Legislative Decree 78 of 31 May 2010 converted into Law 122 of 30 July 2010, imposes the need to ask customers to communicate their VAT NUMBER and TAX CODE in the appropriate fields on the site.
CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The sales contracts of the products on the website www.marricreo.com are considered concluded at the moment in which the purchase order made by the customer reaches MARRICREO and the latter accepts it. MARRICREO di Simona Novi will promptly send the customer a receipt of the purchase order made by the customer.
By electronically sending the purchase order, the customer declares that he has read and accepted these general contract conditions and undertakes to observe and respect them in his relations with MARRICREO di Simona Novi.
PAYMENT
The customer can make the payment due by choosing one of the following methods listed.
Payment by credit card: In the event that the consumer intends to make the payment by credit card, he can use the payment procedure with PayPal, suitable for ensuring the confidentiality of the data provided by the customers. For any information and further Legal Agreements, the Customer is referred to consult the site www.paypal.com.
Payment on delivery: payment on delivery is accepted only if made by cash, payments made by bank check will not be accepted. Any additional cost is to be attributed only and exclusively to the Courier chosen and used by MARRICREO at the time of the order.
Payment by bank transfer: Payment by bank transfer can be made using the following details:

In the event that payment is made by bank transfer, the purchased item will be shipped using the methods indicated in the following paragraph "Product Delivery", to the address indicated by the customer upon receipt of the credit, therefore on average within two/five days after the transfer has been made (the timing varies depending on the Credit Institute used). To facilitate the process, the payment receipt can be sent by email to: info@marricreo.com
DELIVERY OF PRODUCTS
The purchased good, together with the relative invoice, is delivered by courier to the address specified by the Customer at the time of the online order. Any specific needs must be reported by the customer to MARRICREO di Simona Novi at the time of the order itself.
MARRICREO by Simona Novi guarantees delivery of the goods within 20 (twenty) working days from the date of receipt of confirmation of the transaction. (For payment by cash on delivery, the 20 days will be counted from the date of receipt of the order via email.). In the event that the customer chooses the cash on delivery method, payment must be made exclusively in cash, to be delivered directly to the courier upon receipt of the goods.
In the event of non-delivery due to the recipient's absence, at the address indicated in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender MARRICREO di Simona Novi Via Madonna Del Pantano GIUGLIANO IN CAMPANIA
WARRANTY OF CONFORMITY AND DEFECTIVE PRODUCTS
The products purchased on the website www.marricreo.com are subject to the discipline on the sale of consumer goods. The products delivered comply with the characteristics illustrated online in the relative descriptive and technical sheets.
MARRICREO by Simona Novi is responsible towards the customer for any defects in conformity existing at the time of delivery of the goods.
RIGHT OF WITHDRAWAL
The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with MARRICREO di Simona Novi, without any penalty and without specifying the reason, within the term of 10 (ten) ten working days from receipt of the goods.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the site www.marricreo.com
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
The right of withdrawal is exercised by sending, within the aforementioned deadline, a written communication to the address of MARRICREO di Simona Novi by registered letter with acknowledgement of receipt.
The communication of withdrawal may also be sent, within the same deadline, by telegram or fax, provided that it is confirmed by registered mail with return receipt within the following 48 hours.

If the goods have been delivered, the customer is required to return them to

within 20 (twenty) working days from the date of delivery of the goods.
The item must be returned to MARRICREO di Simona Novi complete with all accessories, instruction manuals and everything originally delivered to the customer, as well as packaged in its original packaging. A copy of the electronic receipt of the order must be attached to the returned product. The costs of returning the item to MARRICREO di Simona Novi are the responsibility of the customer.
If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, MARRICREO di Simona Novi is required to refund the sums paid by the customer.
In particular, MARRICREO di Simona Novi will proceed free of charge to transmit the re-credit order relating to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the exercise of the right of withdrawal by the customer. This operation will be carried out through the credit institution issuing the credit card used for payment or by crediting the sum to the bank account indicated by the customer.
MARRICREO di Simona Novi has the right to reject any product returned using methods other than those specified above, as well as products for which the return costs have not been paid in full by the customer, or the methods and times indicated for communicating the exercise of the right of withdrawal have not been respected.
EXPRESS TERMINATION CLAUSE
In the event of total or partial non-payment of the purchase price of the goods, MARRICREO di Simona Novi reserves the right to declare this contract terminated pursuant to and for the purposes of art. 1456 of the civil code by sending a written communication to the customer's email address.
COMPLAINTS
For any complaints or clarifications, the customer must contact The customer will be contacted for clarifications within 3 (three) working days of the request.
APPLICABLE LAW AND COMPETENT COURT
This contract is governed by Italian law. The exclusive jurisdiction and venue for any legal action brought by the Buyer under this warranty or any additional legal warranties will be the Court of Naples. In the event of victory of MARRICREO di Simona Novi in any legal action, the plaintiff will have to reimburse MARRICREO di Simona Novi for the costs, including attorneys' fees and court costs, incurred by MARRICREO di Simona Novi for its defense.
REFERRAL
For anything not expressly provided for in this contract, the provisions of current Italian law shall apply.
